Thomas Truelove 1814

This is the Last Will and Testament of me Thomas Truelove of Castlethorpe in the County of Buckingham Shoemaker being of sound memory and understanding First I will order and direct that all my just Debts funeral and testamentary Expences shall be paid And I give devise and bequeath unto Joseph Kitelee of Castlethorpe aforesaid Gentleman All those my four Cottages or Tenements with their Appurtenances situate and being at Castlethorpe aforesaid One whereof is in my Occupation and the other three are in the several Tenures or Occupations of Thomas Harris John Elliott and Frances Gostellow Upon Trust and confidence that the said Joseph Kitelee his Heirs Executors Administrators and Assigns do and shall after my decease let and set the said four Cottages or Tenements and Premises to such persons and for such rents as he and they shall consider the fair value thereof And I direct my said Trustee his Heirs Executors Administrators and Assigns to pay the Rents of my said four Cottages or Tenements and Premises when and as he and they shall receive the Same unto my natural Daughter Sarah Austin of Castlethorpe aforesaid (Wife of John Austin) for and during the term of her natural life to and for her sole and separate use the same not to be subject to the Debts controul or engagements of her husband And I direct that her Receipt alone for the said Rents or any part thereof given to my said Trustee his Heirs Executors Administrators or Assigns shall be a good and sufficient discharge for the same notwithstanding her Coverture And after the decease of the said Sarah Austin I give and devise my said four Cottages or Tenements and Premises with their Appurtenances unto her two Children Thomas Austin and Sarah Austin their Heirs and Assigns for ever to take as Tenants in Common and not as joint Tenants And I give and bequeath all and Singular my Goods Household Furniture Stock and Implements in Trade Monies Securities for Money Book Debts Chattels Effects and all other my personal Estate whatsoever unto my said natural Daughter Sarah Austin to and for her own use and benefit subject to the payment of my Debts funeral and testamentary Expences and my Will is and I do hereby declare that my said Trustee his Heirs Executors Administrators or Assigns shall not be answerable or accountable for any more rents or Monies than he or they shall actually receive nor for any loss which shall happen to the same without his or their wilful neglect And that it shall and may be lawful for any said Trustee his Heirs Executors Administrators and Assigns out of the said Rents and Monies to deduct and reimburse himself and themselves all such Costs Charges and Expences which he or they shall sustain expend or be put unto for or by reason of the Trusts hereby in him reposed or in the execution of this my Will And lastly I do hereby nominate constitute and appoint the said Joseph Kitelee sole Executor of this my Will and do hereby revoke all former and other Wills and Testamentary Instruments heretofore by me made In Witness whereof I the said Thomas Truelove the Testator have to this my last Will and Testament contained in two sheets of paper and to each sheet thereof set my hand and seal the tenth day of March in the Year of our Lord One thousand eight hundred and twelve Thomas Truelove Signed sealed published and declared by the said Testator Thomas Truelove as and for his last Will and Testament in the presence of us, who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses Catharine Lamb Junr William Kitelee Servant Elizabeth Kitelee

Proved the 28th day of July 1814 Before the Reverend Luke Heslop D.D. Archdeacon and Commissary &c. By the oath of Joseph Kitelee the sole Executor to whom Administration was committed he being first sworn duly to administer
