John Nasbey 1831

This is the last Will and Testament of me John Nasbey of Castlethorpe in the County of Buckingham Lace manufacturer bring of sound mind memory and understanding ff I direct that all my just debts ffuneral and Testamentary expences shall be paid And I give and devise all that my Messuage or Tenement and premises with their appurtenances situate and being in Castlethorpe aforesaid in which I now live unto my Wife Mary Nasbey and her assigns for and during the term of her natural life if she so long continues a Widow and from and after her decease or marriage I give devise the said Messuage or Tenement and premises unto my Daughter Catherine Nasbey her heirs and assigns for ever and I devise and bequeath unto my friends William Boyes of Stony Stratford in the County of Buckingham Draper William Green of Stony Stratford aforesaid Butcher and my said wife Mary Nasbey all and every other my Messuage or Tenements Closes Houses Hereditaments and Real estate whatsoever and also all my personal estates whatsoever or kind the same may be To hold my said Real and personal estates and any part thereof unto the said William Boys William Green and Mary Nasbey and the survivor of them his and her their executors administrators and assigns do and shall at any time after my decease in case any chargeable or advantageous offer shall be made for the whole or any part of my Real estates to sell and dispose of the same or any part thereof as they may think proper and also convert into money such part of my personal estate as shall not be in money and collect and get in all such debts as shall be out and owing to me after paying the expences of such sales I direct my said Trustees and the survivor of them his her Executors and Administrators pay off and discharge all my just debts ffuneral and Testamentary expences and after payment thereof I direct my said Trustees and the survivor of them his or her Heirs Executors and administrators to put and place out at interest all the residue and remainder of the said Trust monies and pay such security as they shall think proper and the interest thereof as the same becomes due I will order and direct shall be received by my said Wife Mary Nasbey and her assigns for and during the term of her natural life if she so long continue a Widow for the maintenance and support of herself and my said Daughter Catherine Nasbey and from and after the decease or Marriage of my said Wife I give and bequeath one moiety of the said residue and remainder of any real and personal estates unto my said Trustees or the survivor of them or the heirs Executors or Administrators of such survivor upon trust to place the said interest on good real or Government securities and to pay the annual Interest Dividends profits and proceeds thereof unto my daughter Catherine Nasbey during the term of her natural life without the control of any Husband which may be then living and that the receipt or receipts of my Daughter only shall be deemed a good and sufficient discharge for the same and I do further declare that my said Daughter shall not at any time sell assign in any way dispose of or anticipate the annual Interest arising from the said moiety and as to the other moiety thereof I give devise and bequeath the same to my said Daughter Catherine Nasbey to and for her own use provided always nevertheless and it is my will and mind and I hereby direct that in case my said Daughter Catherine shall attain the said age of twenty one years and my said Wife Mary Nasbey shall be still living and remaining my Widow then and in that case they my said Trustees or the survivor of them to pay unto my said Wife Mary Nasbey all the rents issues profits proceeds dividends and interests of all my real and personal estates whatever and wherever and of what nature and kind soever the same may be during the term of her natural life or Widowhood and from and after the determination of that period I direct that the surviving Trustee or Trustees or their Heirs Executors or Administrators shall by public auction or by private contract sell and dispose of all my Real estates provided they are not disposed of before either together or in lots as to them may seem best for the best price or prices that can be obtained for the same and the whole of the money therefrom and also all the money arising from every part of my personal estate of what nature and kindsoever the same may be distributed and divided to and amongst my Sisters Ann Nasbey Elizabeth Nasbey Susannah Tooth Martha Goodman and my Nephew William Nasbey son of my brother Thomas Nasbey of Banbury in the County of Oxford Wine and Brandy Merchant Elizabeth Page and Ann Nasbey Daughters of my said Brother Thomas Nasbey share and share alike as tenants in common To hold for my said Trustees such shares of the above mentioned property as my said Sisters Susannah Tooth and Martha Goodman may be entitled to and trust to place the same at interest on good real or Government security and the money arising therefrom to be paid to them respectively for their own benefit without the control of any Husbands which may be then living and that the receipts of the said Susannah Tooth Martha Goodman shall be deemed as good and sufficient discharge and I do hereby further declare that my said Sisters Susannah Tooth and Martha Goodman shall not at any time sell assign or in any way dispose of or anticipate the annual interest Dividends profits or proceeds arising from the share of the said property so given and bequeathed to them respectively on any account or pretence whatsoever but shall apply the same to their own use and further it is my will and mind and I hereby order and direct that in case of the death of either of my two Sisters Susannah Tooth and Martha Goodman then the survivor of them shall be entitled to and receive the Interest of the whole of both shares subject to such directions as are herein given respecting their respective shares And from and after the death of both my Sisters Susannah Tooth and Martha Goodman then I order and direct that my said Trustees do distribute unto and amongst such Child or Children lawfully begotten of my said Sisters Susannah Tooth and Martha Goodman as shall then be living the shares of my said Sisters Susannah Tooth and Martha Goodman share and share alike as Tenants in common and facilitating the sale of my said Real estate as aforesaid I direct and declare that the receipt and receipts of my said Trustees and the survivor of them his and her then shall be to the purchaser or purchasers of my said estates sufficient discharge and discharges for so much money as in receipts shall be expressed to be received and that the purchaser so paying the same shall as afterward be liable to see to the application thereof or be answerable or accountable for any loss or misapplication thereof and I hereby order and direct that my said Trustees or the survivor of them his and her Heirs Executors and Administrators shall and may retain and reimburse himself and themselves out of the Trust monies all such costs charges journies trouble and expence as they may incur sustain or may be put unto in the execution of the Trust hereby in them respond and that they my said Trustees or the survivor of them his or her heirs Executors or Administrators shall not be accountable for any loss or damage which may happen to the said trust money or any part thereof unless through his her or their wilful neglect or shall be or shall be answerable the one for the other nor for the acts deeds receipts or defaults the one for the other but each of them for his her own acts deeds receipts and defaults only and lastly I do hereby nominate constitute and appoint the said William Boys William Green and my Wife Mary Executors and Executrix of this my Will and also Guardians to my said Daughter Catherine during her minority and I hereby revoke all other Wills and Testamentary Instruments heretofore by me made In Witness whereof I the said John Nasbey the Testator have to this my last Will and Testament contained in four sheets of paper and to each sheet thereof set my Hand and Seal this seventeenth day of May in the year of our Lord One thousand eight hundred and twenty eight Jno. Proved in London 1st ffebruary 1831 before the Judge by the Oaths of William Boyes in the Will written Boys William Green and Mary Nasbey Widow the Relict the Executors to whom Administration was granted having been first sworn by Commission only to Administer
